Terms of Use

Changes on 10 October 2026. This version applies to new accounts from sign-up, and to existing accounts from 10 October 2026; until 9 October inclusive, the latter remain governed by the version of 10 September 2026. Summary of changes.

English translation, provided for convenience. The French version of these Terms (Conditions générales d'utilisation) is the only binding text. In the event of any discrepancy, the French version prevails.

1. Purpose

These Terms of Use (the “Terms”) govern access to and use of the Colors Clubs, Colors Pro, Colors Pro Lite and Colors Manager applications, as well as the colorsclubs.com website. By creating an account or using the Services, you accept these Terms in full.

2. Definitions

Platform: all applications and services published by NEXA G GROUP.
Club: an entity run by a Manager, holding one licence per country, bringing together drivers and offering transport categories.
Passenger: a user who books a ride.
Pro (driver): a professional who carries out rides, attached to a referring club.
Manager: the operator of one or more clubs.
Colors Art: a digital collectible tied to a category, tradeable within the Vault.
Merhcure (“M”): an internal, non-monetary token, earned and spent within the Platform.
Vault: the area of the Platform dedicated to acquiring and collecting Colors Arts and badges.
Colors Cash: a cash settlement method managed by the Platform.

3. Account & registration

Registration requires accurate information (identity, contact details, country). Users must be at least 18 years old, or of the legal age required in their country for drivers. Each user is responsible for keeping their credentials confidential and for all activity carried out from their account. Drivers and managers must provide the required supporting documents (identity document, vehicle documents, company information where applicable), which are verified before activation.

4. Roles

Passenger

The passenger books rides with the clubs of their choice, may negotiate certain fares, pays using the payment methods available in their country, and rates the services received.

Pro (driver)

To go online, a driver must have a referring club, approved activities and a means of collecting payment. They undertake to comply with local transport regulations, to keep their documents up to date, and to provide a compliant service.

Manager

The manager handles licences, extensions, badges, options and the configuration of their clubs, approves driver affiliation, and ensures the proper running of their club(s).

5. Rules of use

Users must not, in particular: circumvent the Platform in order to avoid commissions; impersonate anyone; publish unlawful or defamatory content; disrupt the operation of the Services; collect other users' data; or use the Services for fraudulent purposes. All published content (messages, photos, reviews) must comply with the law and with third-party rights.

6. Merhcure & Colors Arts

The Merhcure is the Platform's unit of account. It is not legal tender and may not be transferred to a third party outside the uses provided for in the application. Its indicative internal value is €0.001 per Merhcure; this value may change.

Six categories coexist depending on origin, set at issuance and attached to each Merhcure for its entire life. Full Merhcure — received for a service performed — form a recoverable reserve: usable everywhere, and the only ones that can be transferred to a bank account. Sealed Merhcure — purchased in the application, on the website or by mobile money, in the currency of the purchase — can be used anywhere in the application (Vault, services, commissions, debts) but never leave for a bank. Voucher Merhcure — top-up vouchers and codes, cashback, Pool bonuses, partnership Merhcure that have reached maturity — pay only for services, commissions, debts, donations and Pass Trips, with no use in the Vault and no transfer out. Advertising and Vault Merhcure are used exclusively in the Vault. Partnership Merhcure are unavailable until the stated maturity date. The passing of a term never makes transferable a Merhcure that was not. Each Merhcure is tied to a currency; exchange into another currency is possible only if the original currency allows it, at the rate shown before confirmation, and does not change the category.

Colors Arts are digital collectibles. Holding one confers a personal right of use within the Platform but guarantees no monetary value and transfers no intellectual property rights. The mechanics of acquisition, trading, extraction and rarity are described in the application and may change.

7. Moderation & suspension

The publisher may suspend or close an account (“hold”), remove content, or exclude a user from a club in the event of a breach of these Terms, fraud, non-payment, an invalid document, or conduct that endangers the safety of others. Decisions to activate roles and documents may be automated and/or subject to manual review.

8. Liability

The Platform acts as a technical intermediary connecting parties. It is not a party to the transport contract entered into between the passenger, the club and the driver, and does not guarantee the availability, punctuality or quality of the services performed by drivers. The publisher cannot be held liable for acts attributable to users or third parties, nor for service interruptions beyond its control.

9. Termination

An account is personal and may only be used from one device at a time. Signing in on a new device ends the previous session. Sharing credentials, simultaneous use by several people, and holding multiple accounts as the same person are prohibited and may justify suspension.

Users may close their account at any time from the application or by writing to [email protected]. Closure results in the loss of any Merhcure and Colors Arts not transferred, subject to statutory retention obligations.

10. Changes & governing law

The publisher may amend these Terms. Users are informed of substantial changes. These Terms are governed by French law, without prejudice to mandatory consumer protection provisions applicable in the user's country of residence.
